**** The GA law establishes these levels for new construction but notes that the WC levels are for all sales.

**** CO HB 1161 (2023) establishes that showerheads packaged together with tub spout diverters (i.e. showerhead tub spout diverter combinations) are a separate product from individually packaged showerheads and are subject to 1.8 gpm maximum flow rate in accordance with CCR § 1605.3. CDPHE Interpretation available here.

Note 1: Texas HB 2667 exempts flushometer and wall-mounted water closets from this requirement.

^^ For residential lavatory faucets:

  • Maximum 2.2 gpm at 60 psi – Manufactured prior to September 1, 2015.
  • Maximum 1.5 gpm at 60 psi – Manufactured on or after September 1, 2015 and prior to July 1, 2016.
  • Maximum 1.2 gpm at 60 psi – Manufactured on or after July 1, 2016.

For showerheads:

  • Maximum 2.0 gpm at 80 psi - Manufactured after July 1, 2016 and prior to July 1, 2018.
  • Maximum 1.8 gpm at 80 psi – Manufactured after July 1, 2018.
  • All showerheads shall have a minimum flow rate of 60 percent of the maximum flow rate at 20 psi.
  • All showerheads shall have a minimum flow rate of 75 percent of the maximum flow rate at 45 psi.

Note 2: CO SB-103 only applies to lavatory faucets, showerheads, flushing urinals and tank-type water closets. Click here for more information.
^^^ City of Los Angeles requires all urinals to have a maximum flush volume of 0.125 gpf for new construction.

Note 3: This applies to new construction in the greater Chicago area (more specifically those in Illinois that obtain their water from Lake Michigan).

Note 5: Requirements include: minimum MaP Score of 600 for all water closets; maximum flow rate of 1.8 gpm for all showerheads except for those installed in institutional and educational occupancies (e.g. hospitals, assisted living facilities, K-12 schools); and maximum flow rate of 0.5 gpm for private lavatory faucets installed in non-residential occupancies except institutional (e.g. hospitals, assisted living facilities). Note 6: Effective sale date applies to all products manufactured on or after January 1, 2021.

Note 7: For the following products sold on or after January 1, 2021: residential kitchen faucets shall have a maximum flow rate of 1.8 gpm with an optional temporary flow of 2.2 gpm; public lavatory faucets shall have a maximum flow rate of 0.5 gpm; and flushometer- valve water closets shall be certified to the EPA WaterSense Program. Note 8: According to the main proponents of NV AB 163 (Assemblyman Howard Watts and Senator Chris Brooks), the January 1, 2020 effective date only applies to new installations. Local governments are responsible for updating their building codes or ordinances to enforce the requirements of NV AB 163 and not a state agency. Furthermore, based on the Nevada Revised Statutes (NRS) 278.582 – Section 1, local governments are supposed to eventually update their ordinances to address product sales as well. There is no deadline indicated within NV AB 163 or NRS 278.582 for when this is to occur.

Note 9: Water closets that are in a “remote location” can have a maximum flush volume of 1.6 gpf. “Remote location” is defined as “a water closet located not less than 30 feet (9144 mm) upstream of the nearest drain line connections or fixtures, and is located where less than 1.5 drainage fixture units are upstream of the water closet drain line connection.”

Note 10: Effective sale date applies to faucets and showerheads manufactured on or after January 1, 2022.

Note 11: Effective date applies to products for sale on or after January 1, 2022.

Note 12: Effective date applies to products for sale on or after January 1, 2023.

Note 13: Kitchen Faucets updated from 2.2 to 1.8/2.2 gpm in accordance with D.C. Law 23-195. Energy Efficiency Standards Amendment Act of 2020, with an effective sell through date of March 15, 2022.

Note 14: Effective date applies to products for sale on or after January 18, 2023.
